These terms govern your use of jennyxie.com (the Site). The Site is operated by or on behalf of Xie Meizhong, Jenny (Jenny), a property salesperson registered with the Council for Estate Agencies (CEA registration no. R029803H) with ERA Realty Network Pte Ltd (estate agent licence no. L3002382K) (ERA).

By using the Site you agree to these terms, together with the Privacy policy, PDPA and Do Not Call notice, Disclaimer, CEA notice and Cookies notice, which form part of them. If you do not agree, please do not use the Site.

1. Who these terms protect

Protected Parties means Jenny; ERA and its directors, key executive officers, employees and salespersons; each person who designs, builds, hosts, secures, operates or supplies data or content to the Site on Jenny’s behalf, including website, hosting, network-security and customer-relationship platform providers, and news and data sources; and the officers, employees and agents of each of them.

Clauses 7, 8 and 9 are intended to benefit every Protected Party, and each of them may enforce those clauses under the Contracts (Rights of Third Parties) Act 2001. Jenny may vary or end these terms without the consent of any other Protected Party.

2. What the Site is, and what it is not

The Site provides general information about Jenny’s services as a salesperson and about residential property in Singapore.

It does not create a client relationship. Using the Site, or sending an enquiry through it, does not make you a client of Jenny or of ERA. Where you appoint ERA, the work is done under a written estate agency agreement between you and ERA. Where Jenny acts for a seller, landlord or developer, she acts for that client, not for you, and will tell you so. No duty of an estate agent, and no fee or commission, arises from your use of the Site alone.

It is not an offer. Listings and project pages invite enquiries. They are not offers capable of acceptance, and no property is reserved, held or allocated through the Site.

It is not advice. Nothing on the Site is legal, tax, financial, investment, valuation or financing advice. See the Disclaimer.

It is Jenny’s site, not ERA’s. The Site is not ERA’s corporate website. ERA’s name and licence number appear because the CEA requires every advertisement by a salesperson to identify the estate agent. Any transaction you proceed with is also subject to ERA’s own terms and policies.

3. Acceptable use

You may use the Site for your own lawful, personal purposes. You must not, and must not help anyone else to:

  • use the Site in breach of any law, including the Estate Agents Act 2010, the Personal Data Protection Act 2012, the Spam Control Act 2007 and the Computer Misuse Act 1993;
  • copy, scrape, crawl, harvest or systematically extract any part of the Site by automated means, including listings, project information and contact details, except for indexing by a search engine that follows the Site’s robots.txt;
  • collect phone numbers or email addresses from the Site to send marketing messages;
  • use any part of the Site to develop, train, fine-tune or evaluate a machine-learning or artificial-intelligence system;
  • submit an enquiry that is false or misleading, submit one in another person’s name, or submit another person’s personal data without their authority;
  • submit anything that is defamatory, obscene, threatening, infringing or unlawful, or that contains malicious code;
  • probe, scan or test the security of the Site, get around its security or rate-limiting measures, or interfere with its operation or with anyone else’s use of it;
  • frame or mirror the Site, or present any of its content in a way that suggests Jenny or ERA endorses you, your business or your listing;
  • use Jenny’s name, image or likeness, her CEA registration details, or ERA’s name or licence details to impersonate or suggest an association with either of them.

Jenny may refuse, block or restrict access to the Site, disregard or delete any enquiry, and remove any material, at any time and without notice, if she reasonably believes these terms have been breached.

4. Enquiries and information you send

When you send an enquiry, you confirm that the information is accurate, that it is yours or that you are authorised to provide it, and that you have read the Privacy policy.

Sending an enquiry does not secure a response within any particular time, a viewing, a price, or the availability of any property. Jenny may be unable to act on an enquiry, for example where she has a conflict of interest, where she is not authorised to market a development, or where acting would breach the CEA’s rules. If a matter is urgent, call her on the CEA-registered number shown on every page.

Please do not send NRIC or passport numbers, bank or card details, or health information through the Site’s forms.

Payments and impersonation. Jenny will never ask you to pay money into a personal account. Pay option fees, deposits and commission only as your option to purchase, your sale and purchase agreement or an ERA invoice directs. Jenny’s only mobile number is +65 8613 3111. If anyone using another number claims to be her, please report it to her on that number or to ERA.

5. Ownership of content

Except where stated otherwise, the text, design, layout, graphics, images, code and other material on the Site (Content) belong to, or are used with the permission of, Jenny or another Protected Party, and are protected by the Copyright Act 2021 and other laws. ERA’s name and marks belong to ERA.

Some Content belongs to others and is used with permission, under licence or as the law allows:

  • new-launch project information is compiled from developers’ published material and public sources, and supplied to the Site through a customer-relationship and listings platform;
  • news headlines are published by the news source named beside them, and link back to that source;
  • public data, including Jenny’s transaction record from the CEA Salespersons’ Property Transaction Records (residential), is used from data.gov.sg under the Singapore Open Data Licence and is attributed where it appears.

You may view the Site, and print or save a reasonable number of pages, for your own personal, non-commercial use in considering a property decision, provided you keep any copyright and source notices. No other right is granted. In particular, nothing on the Site grants you any right to use Jenny’s name, image or likeness, or ERA’s name or marks.

If you believe Content on the Site infringes your rights, please tell Jenny through the contact page, giving: the work concerned; the address (URL) of the page on which it appears; your name and contact details; and a statement that the information in your complaint is accurate and that you own, or are authorised to act for the owner of, the rights concerned. Material that appears to infringe will be removed or disabled promptly while the complaint is considered.

7. No warranties

The Site and its Content are provided “as is” and “as available”. To the fullest extent permitted by law, no Protected Party gives any warranty or representation, express or implied, that the Site or any Content is accurate, complete, current or fit for any purpose, that it does not infringe anyone’s rights, or that the Site will be available, uninterrupted, secure or free of errors or harmful code.

Information about any property or development, including its price, size, layout, unit mix, tenure, completion date and facilities, comes from owners, developers and public sources, can change without notice, and must be checked independently before you rely on it.

8. Limitation of liability

To the fullest extent permitted by law:

  1. no Protected Party is liable for any loss or damage arising from or in connection with your use of, or inability to use, the Site; your reliance on any Content; any third-party website, content or service; any delay in, or failure of, the delivery of an enquiry or message; or any unauthorised access to, or alteration of, any transmission or data, whether the claim is brought in contract, tort (including negligence), for breach of statutory duty or otherwise;
  2. no Protected Party is liable for any indirect or consequential loss, or for any loss of profit, opportunity, bargain, anticipated savings, goodwill or data, however caused; and
  3. where liability cannot lawfully be excluded but can be limited, the total liability of all Protected Parties together, for all claims arising from the Site, is limited to S$100.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law. Nothing in these terms affects any obligation owed to you under the Estate Agents Act 2010 or its Code of Ethics and Professional Client Care, under the Personal Data Protection Act 2012, or under an estate agency agreement you have signed, which is governed by its own terms.

This clause covers the Site as a free information service only. It does not apply to advice, representations or services given to you in the course of estate agency work, which are governed by the Estate Agents Act 2010, its Code and any agreement you sign.

9. Your responsibility for misuse

You agree to compensate each Protected Party for any claim, loss, liability or reasonable cost (including reasonable legal costs) that it suffers to the extent that it is caused by your breach of these terms, your misuse of the Site, or information you submit that is unlawful or that infringes another person’s rights, except to the extent that the loss is caused by that Protected Party’s own act or omission.

10. Other websites

Links to other websites, including news publishers, developers, government agencies and messaging services such as WhatsApp, are provided for convenience only. They are not an endorsement, and those websites and services are governed by their own terms and privacy policies.

11. Changes

Jenny may change, suspend or withdraw the Site or any part of it, and may update these terms, at any time. The date at the top of this page shows when they were last updated. By continuing to use the Site after an update, you accept the updated terms. Listings and project pages are removed as soon as practicable once a property or development is no longer available to be marketed.

12. General

If a signed estate agency agreement or other written contract with you conflicts with these terms, that contract prevails. If any part of these terms is found to be unenforceable, the rest continues in effect, and that part applies to the extent it is enforceable. A failure or delay in enforcing any part of these terms is not a waiver of it. If these terms are translated, the English version prevails.

These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute arising from them or from the Site. This does not affect any right you have to bring a claim before the Small Claims Tribunals, or to complain to the Council for Estate Agencies or the Personal Data Protection Commission.
